Wheel Witness

In order to be found guilty of DUI, the State must have a “wheel witness.” In other words, they must have some evidence (usually the testimony of a person) to show that you were the person who was actually driving the car. In most cases the wheel witness is the officer who performs the traffic stop. But in some cases, it is a civilian witness such as a passenger, passing motorist or accident victim.

If an officer arrives and no one is behind the wheel at the time of the stop you may be able to challenge the State’s allegation that you were the person driving. The experienced defense staff of Finebloom & Haenel can review your case and determine if there is a wheel witness. If not, they have the means to provide an excellent “wheel witness” defense.
