Jail Time

Jail time is always a possibility in a DUI case. In some cases jail time is mandatory.

  • 1st DUI: Not more than 6 months.
  • 1st DUI With BAL of .15 or higher: Not more than 9 months.
  • 2nd DUI: Not more than 9 months.
  • 2nd DUI With BAL of .15 or higher: Not more than one year.
  • 2nd DUI within 5 years: Mandatory imprisonment of at least 10 days but not more than one year.
  • 3rd DUI outside of 10 years: Not more than one year
  • 3rd DUI within 10 years: Mandatory imprisonment of at least 30 days. At least 48 hours of confinement must be consecutive. If it is charged as a felony, it could be up to five years in the Department of Corrections.
  • Fourth or Subsequent Conviction: Not more than 5 years in the Department of Corrections (as long as you do not fall into the habitual offender category).


If there was a death or serious bodily injury the penalties are more severe;

  • DUI with Serious Bodily Injury: Up to 5 years
  • DUI Manslaughter: Up to 15 years
  • DUI Manslaughter if you left the scene: Up to life
  • Vehicular Homicide: Up to 15 years
  • Vehicular Homicide if you left the scene: Up to 30 years If you are entering residential treatment, the judge can credit any time spent in an approved treatment facility toward a jail sentence.
