First 10 days: Challenging the Suspension

IT IS VERY IMPORTANT TO CONTACT AN ATTORNEY WITHIN THE FIRST TEN DAYS OF A DUI ARREST IF YOU WANT TO CONTINUE TO DRIVE!

When you are arrested for DUI, the officer will take away your license. The ticket you are issued serves as a temporary license for the next ten days.

You only have 10 days from the date of your arrest to challenge the suspension!!

If you do not challenge the suspension you will not be able to drive anywhere for 6 to 18 months depending on your offense!!!

If you do not take action in the first ten days you will lose your opportunity to challenge the suspension!

When you are arrested there is an automatic suspension imposed by the Department of Highway Safety and Motor Vehicles known as an Administrative Suspension. You receive this suspension whether you take the breath test or not.

  • If you take a breath test and blow over a .08 your license will be suspended for 6 months.
  • If you refuse the breath test for the first time your license will be suspended for a year.
  • If it is at least the second time you have refused a breath test your license will be suspended
