An “enhanced” DUI is one where a breath test result was obtained and the result was over a 0.15 BAC. This means that when you took the breath test, the machine read your breath alcohol content as being a .15 or more.
Enhanced DUIs carry additional penalties. For any blow that is .15 or over an ignition interlock is required upon conviction. The maximum jail penalty is increased by three months for first and second offenses. Statutory fines are doubled.
At the law offices of Finebloom & Haenel we know how to challenge an enhanced DUI charge. Our attorneys have over 35 years of combined experience in this area. When you hire our defense team, we challenge every aspect of your DUI charge. Our attorneys investigate your case to determine:
- Was there a reason to conduct a traffic stop?
- Were the proper procedures followed roadside?
- Were there any issues or problems in the arrest or booking of our client?
- Was testing protocol followed?
- Was the machine in working order?
We question the officers, review video footage, and order all additional reports. In addition, we stay current on all litigation that challenges the use of the Intoxilyzer 8000 and its results.
An enhancement in your DUI charge can lead to extended jail time, increased fines and a longer license suspension. It can also result a requirement for an ignition interlock device in your vehicle, which is very expensive, cumbersome and embarrassing.
