Inoperability

It is a defense to the charge of DUI if at the time of the alleged offense, the vehicle was inoperable. Inoperable means the car is unable to be driven. It is not often that a person has an inoperability defense. Here is an example. If you are sitting in your driveway listening to the car radio while drinking, but the car has no engine, you would have a defense of inoperability.

It is not a defense if you were driving under the influence before the vehicle became inoperable. For example, if you are drinking and drive your car into a tree, and the officer arrives and arrests you, you will not have the defense of inoperability.
